Terms and Declarations
I declare and agree to the following:
- Authorisation and Jurisdiction
I authorise My Sheikh Online to assess and adjudicate my request for an Islamic divorce. I accept that the ruling will be made in accordance with the Islamic legal framework applied by the Council, and I agree to abide by it.
- Acknowledgement of Procedure
I have read and understood the full divorce procedure published on the My Sheikh Online platform. I agree to comply with each stage of the process, including communication, evidence provision, and hearing attendance.
- Non-Refundable Fee
I acknowledge that the fee of £380 or £490 is non-refundable once proceedings begin, regardless of the final decision or whether I later withdraw the application.
- Exclusive Submission
I confirm that I have not submitted this case to any other Islamic council or civil court for the purpose of Islamic divorce. I understand that simultaneous applications may cause conflict and compromise the process. I will notify My Sheikh Online immediately if that changes.
- Requirement to Pursue Civil Divorce (if applicable)
If my marriage was recognised under UK civil law, I commit to applying for a civil divorce so that my marital status is reflected both under UK law and Islamic law. I understand that My Sheikh Online cannot dissolve a civil marriage.
- Prohibition on Remarriage Until Completion
I agree not to enter into a new marriage (Islamic or civil) until My Sheikh Online formally grants the Islamic divorce and I have completed the legally required ‘Iddah period.
- Retention and Disposal of Records
I understand that My Sheikh Online will retain my application and case file securely for a period of 1 year, after which it will be confidentially destroyed. Inactive applications (with no follow-up) will be held for 1 month and then discarded. Registered cases placed on hold may remain paused for up to 3 months.
- Confidentiality and Data Protection
I understand that all communications, records, and case files should be treated with confidentiality and stored securely in accordance with UK GDPR and data protection laws. Any unauthorised sharing, publishing, or forwarding of private information without written consent is prohibited.
- Duration and Integrity of the Process
I acknowledge that Islamic divorce is a serious matter and that the process cannot be rushed. I understand that no expedited service besides that which has been mentioned exists and that the Council will proceed with appropriate diligence and fairness to both parties.
- Cooperation and Attendance
I agree to attend online or in-person meetings (individual or joint) as required. I understand that joint meetings may be waived if there are valid safeguarding concerns or legal restrictions (e.g., non-molestation orders), which I will disclose with supporting documentation.
- Parental Contact and Child Welfare
If applicable, I agree to sign a Solemn Declaration confirming that I will not obstruct lawful and safe contact between the father and our children, in line with the rulings of the Family Court of England and Wales. I acknowledge that Islamic and civil considerations regarding child custody may differ, and I will seek independent legal advice if needed.
- Respectful Conduct
I will behave respectfully toward all staff, scholars, and other involved parties. I understand that abuse, threats, or harassment will result in immediate dismissal of my case without refund.
- Legal Advice Disclaimer
I understand that My Sheikh Online does not offer legal advice on civil divorce, financial settlement, immigration, or custody. I accept responsibility for seeking independent legal counsel where necessary.
- Financial Settlement Clarification
I understand that the Khul’a process may involve discussion of the mahr (dower) or other financial issues. I will disclose any such matters truthfully and cooperate in resolving them. I accept that Khul’a may include the return of mahr or other agreed terms, and I will not withhold relevant financial details.
- Safeguarding Declaration
I confirm that there are no immediate safeguarding risks (such as serious domestic abuse or threats of harm) that would make involvement in this process unsafe. If any safeguarding concerns arise, I will notify My Sheikh Online immediately and understand the Council may refer or pause the case accordingly.
- Truthfulness and Honesty
I declare that all information provided by me in this application and during the process is accurate and truthful. I understand that knowingly providing false or misleading information may result in my case being dismissed and, if necessary, legal consequences.
- Third-Party Assistance
If I wish to have a representative or third-party (such as a family member or legal advisor) present in any part of the process, I will request permission in advance and comply with any relevant procedures or consent forms required.
I hereby agree to indemnify and hold harmless My Sheikh Online and all associated personnel against any legal claims, disputes, or liabilities—whether direct or indirect— arising from or related to the involvement of any second or third party, associate, or external party in my matter.
